Less than one day after CANACE released three hardhitting editorials criticizing the harebrained plan by Brantford developers and their ‘Haldimand Tract Good Neighbours Coalition’ to sell out the rule of law in Canada, the thugs who were to benefit from the scheme demonstrated, for all to see, the mindnumbing folly of the plan to ask municipalities to pay native extortionists with taxpayers’ money.

Brantford Expositor:”McHale has accomplished something”

In an editorial published today (July 11/08), the Brantford Expositor grudging admitted that Gary McHale, Executive Director of CANACE, is making a difference in pushing the perpetrators of land claim occupations into the court via private prosecutions.
“When we see McHale has been up to something, we normally reach for an 11-foot pole. However, we admit McHale has accomplished something by laying private charges against Floyd and Ruby Montour.”
“McHale is filling a vauum. Although the OPP has been investigating, no charges have resulted.”
“Do the Montours (or anyone else) have the right to shut down development to enforce demands from HDI? It’s time to involve a judge. Of course, the judge would need the wisdom of Solomon. If the charges are upheld, the Montours will say the justice system isn’t fair to natives. If the charges fail, McHale will say the courts are too lenient. All the same, it will be good to clear the air.”

In my previous post, McHale gives Crown bad headache, I explained that Gary McHale’s pre-trial court session regarding the charge against him that took place in Hamilton on July 02/08 did not go very well for the Crown.
I am pleased to advise that Gary McHale won another victory today during a judicial review in a Cayuga courtroom when Judge Marshall (yes, THAT Marshall) agreed with McHale that Justice McDonald erred during McHale’s Bail Variation hearing in Dec 07 once OPP Inspector McLean refused to appear.

1. Gary McHale was at one of his many court appearances over the past few months. This one was a pre-trial session for the charge against him - Counselling Mischief. Now, I can’t repeat what went on during the day, but I can say that it was most definitely NOT a good day for the Crown for many reasons.

Yesterday, the lawyer for Brantford responded forcefully to a threat against Canada and the rule of law from Ovide Mercredi, former National Chief of the Assembly of First Nations, that was - unbelievably - actually read out loud in a Brantford courtroom on Friday:
The man who was the National Chief of the Assembly of First Nations for most of the 1990s had some dire words of warning for Brantford. Ovide Mercredi filed an affidavit from Winnipeg as part of the defence against Brantford’s request for an injunction against native protesters.
“If an injunction is issued in Brantford in these circumstances, I have grave doubts that the peace will hold. Moreover, I think it is important for the court to understand that organized groups, institutions and leaders with aboriginal nations will not … have the authority to control the actions of the individual members of their communities.
“An injunction employed to restrain the exercise and assertion of aboriginal rights not only threatens the public peace and safety but fundamentally undermines the rule of law.”

‘End of the beginning’ for struggle against race-based policing

For those of us who have invested so much in resisting OPP race-based policing, it was good news indeed to discover that Fantino has been forced to tell Six Nations Confederacy chiefs in an emergency meeting that he will have to enforce court injunctions against native protesters who attempt to extort money from landowners via illegal occupations and blockades.

Dramatic developments coincide with CANACE activities

UPDATE 1245 EST May 26/08: Fantino has emergency meeting with Six Nations Confederacy chiefs, tells them he will enforce court orders against native protesters. See ‘End of the beginning’ for struggle against race-based policing.’
While CANACE can’t take credit for all the dramatic developments that have taken place recently, they do seem to coincide with CANACE activism and education efforts.
A quick refresher:
- On May 07/08 CANACE released our latest report, ‘Legalized MYTHS of Illegal Occupations‘ to a packed Cayuga Hall that included business people and developers. MPP Toby Barrett spoke to the crowd and provided an update about Deseronto.
- On May 08/08 CANACE directors met with two federal MPs at a resident’s home in Caledonia where we supplied them with copies of 4 CANACE reports. We have received confirmation that 20 copies of these reports were distributed ‘broadly’ in Ottawa and are ‘causing quite a stir.’
- On May 12/08 CANACE was authorized to gather evidence at a construction site in Cayuga for the purpose of laying criminal charges against native blockaders. Charges should be filed via ‘private informations’ by the end of next week. The OPP subsequently advised the builders that their Criminal division was ‘investigating.’

OPP Commissioner Julian Fantino served subpoena to appear in Cayuga court
Gary and Christine McHale have advised me that they attended Julian Fantino’s home in Woodbridge this evening where Fantino’s wife agreed to accept a subpoena on behalf of her husband to appear in a Cayuga courtroom to answer Gary’s questions during a bail variation hearing set to take place in March. Fantino was not at home.

At 1000 this morning I received an email from MPP Toby Barrett (top photo on right) outlining his attempt to encourage Haldimand County to issue a strongly worded proclamation calling on federal and provincial governments to restore ‘Peace, Order and Good Government’ to their citizens. He even provided a draft proclamation for Council’s “review and action.”

Before we get to VoC’s predictions for the new year, let’s catch up on some notable developments that occurred during the Christmas holidays:
1. Correction: VoC reported that the charges against Doug Fleming (Mischief) arising from the events of Dec 01/07 had been dropped. In fact, the Crown did withdraw the original charge due to a technical error, but replaced it with a new one. VoC regrets the error. Doug is scheduled to appear in court on Jan 23/08.
2. In mid-December, VoC was accused of defaming Six Nations nurse Timothy Sywyk with a false allegation that he had sexually abused a patient. On Dec 28/07 VoC obtained evidence directly from the College of Nurses to support the allegations. See CNO confirms Six Nations RN disciplined for past patient abuse.

VoiceofCanada has received confirmation from the College of Nurses of Ontario (CNO) that the Timothy Sywyk employed as a nurse at a Six Nations health centre is the same person who was disciplined by the CNO in 2007 for sexually abusing a patient.
