McHales do it again: Haldimand Council votes to dismantle Caledonia blockade

Anti-racial policing protest at gates to Douglas Creek Estates, Caledonia.Last year, Gary McHale shut down the illegal Enbridge Line 9 occupation with a single letter to the Hamilton Police, an accomplishment hailed by SUN TV’s Brian Lilley and recounted in the final chapter of Gary’s book, Victory In The No-Go Zone. Now, he (and his wife) have done it again.

It was a long time coming, but Haldimand Council has announced that it will finally do something to reclaim the Caledonia occupation site–the Douglas Creek Estates subdivision–where so many of us volunteered to be repeatedly arrested for ‘trespassing’ and/or ‘breaching the peace’ simply for trying to walk on the public county-owned roads through the site which have been blocked by native militants since 2006:

CALEDONIA – Haldimand County Council has voted to dismantle a blockage set up by protesters at the entrance of the former Douglas Creek Estates.

Mayor Ken Hewitt said the vote happened in camera Monday night. The county will be hiring a contractor to take apart the barrier – fashioned with metal, concrete and other materials – at Surrey Street in Caledonia.

For those wondering about Haldimand council’s sudden discovery of spinal strength, it may help to tell the backstory of which the Spectator was unaware:

Gary McHale recently sent a notice to Haldimand councillors announcing he intended to organize pickets at their homes to dramatize their ongoing failure to enforce the law, a prospect that enraged at least one councillor.

Meanwhile, his wife Christine sent a letter to Ontario Premier Kathleen Wynne  advising her of the crimes being committed by the occupiers from provincially-owned land (some is owned by Ontario, some by Haldimand County) and of the safety risks inherent in allowing native occupiers to remain in the one house still standing:

You should be concerned about the issue of safety of both native and non-native people. With Surrey Street totally blocked off, this prevents emergency vehicles vehicles such as fire trucks, ambulances and police vehicles from being able to drive down Surrey Street in case of an emergency.” –Christine McHale, June 14/14 letter to Premier Wynne

In truth, the McHales didn’t get council to act because of two letters any more than Gary McHale shut down the Enbridge occupation with one letter: the solutions came as a result of a few letters backed by 8 years of powerful, effective activism by people who say what they mean and mean what they say.

It explains how  we applied Ethical Lawfare and Dr. Martin Luther King Jr’s methods in today’s environment of cowardly governments that would rather violate the rights of the innocent than uphold the rule of law against the guilty.

What happens next?

Will the natives turn violent again? Will the crisis flare up over an attempt to clean the property and open public roads to the public?

Janice Fiamengo, a University of Ottawa English professor who is also the editor of the Freedom Press Canada Journal, has written an in-depth review of Gary McHale’s upcoming book, Victory In The No-Go Zone: Winning The Fight Against Two-Tier Policing. The concluding paragraph reads:

Step 1: Gary McHale letter to Hamilton Police promising that he and his supporters would gather evidence and lay charges using Canada’s Private Prosecution provisions in the Criminal Code, including against police officers who might obstruct the gathering of that evidence:

“Starting next week we will, without notice, appear at the illegal occupation in order to video tape criminal behaviour, which includes mischief, and then file private prosecution charges against the protesters. Apparently these protesters believe they can block people from videotaping them – this, of course, is mischief as ruled by the courts.

“If your officers attempt to interfere in the gathering of evidence they too could be arrested and prosecuted on a charge of obstructing justice. Police cannot aid in criminal behaviour and they cannot interfere with the justice system.

At the bare minimum it is our goal to expose any police force that allows a two tier justice system to be institutionalized. Your department has forced a company to get an injunction solely because you decided not to enforce the law.”

 “The move [to arrest the protesters] by Hamilton police comes mere hours after an overnight email to Police Chief Glenn DeCaire from Gary McHale. McHale, a rights activist who played a major role in the Caledonia land claim dispute, criticizing Ontario Provincial Police for their lack of action, told DeCaire in the email that he and his supporters would converge on the Enbridge compound to monitor the behaviour of the protesters and the damage they may have caused. “

Gary McHale and CANACE members have successfully convinced various courts to issue criminal charges against former OPP Commissioner Fantino, now-Commissioner Lewis, Superintendent Gentle, as well as two officers who were filmed helping native occupiers build a fence to keep the owner out of his own property in Hagersville.

THE END OF THE BEGINNING! After 4 arrests & a 31 month campaign Canadians force OPP to respect their right to raise a Canadian flag in Caledonia.

In early 2007 after we were arrested together on Dec 16/06 while trying to raise a Canadian flag opposite the occupation site; during a time when former OPP Commissioner and the OPPA and the media were printing the most vile accusations against him and his followers; and knowing that York Regional Police had been in his home to respond to threats against Gary and his wife Christine from occupation militants; and knowing just how politically-incorrect our mission to end race-based policing was, I said to Gary:

“If, when this struggle is over,  we’re still alive and not in jail, everything else will be a bonus, but no one is going to be pinning any medals on us.”

I’m so glad I was wrong — about the medal. Six Nations militants did try to kill Gary on Dec 02/07 when occupation ringleader Clyde Powless jumped on his back and other cowards joined in, kicking him and screaming obscenitie while he lay on the ground. Fortunately, a quick thinking Doug Fleming tackled Powless and some badly outnumbered OPP officers hustled Gary out of the area. Despite being viciously assaulted Gary never once raised an angry voice or fist in retaliation.

For more six years I have had the honour (and, yes, the frustration sometimes), of working beside a stubborn, determined man who refused – and refuses – to give up until this province and its police force end racial policing and, once again, respect the rule of law.

In the evening, I was honoured to be a guest speaker and presenter at the post-election dinner meeting for the Freedom Party of Ontario where executive members Bob Metz, Robert Vaughan, and leader Paul McKeever explained why the NDP, Liberals and Hudak PCs are all nearly-identical ‘red’ parties more interested in promoting ‘wealth distribution’ than in promoting wealth creation and protecting liberty. 

On the way home my very apolitical wife said, ‘The penny dropped after listening to the speeches. Now I understand the difference between the parties.’

Mark Vandermaas honoured as part of Zachor Coalition at National Holocaust ceremony, Ottawa

VoiceofCanada editor Mark Vandermaas was called to the stage at the National Holocaust Remembrance Day ceremony to be part of the candle-lighting ceremony in honour of the ‘Zachor Coalition’ — the group of organizations who contributed to the event’s success.

In the audience were 45 people who had travelled with Mark via a bus sponsored by the Canadian Society for Yad Vashem including, Caledonia activists Gary & Christine McHale as well as Merlyn Kinrade and his daughter Olivia, along with Al Gretzky from the International Free Press Society; Steve Scheffer from Hamilton’s Never Again group, and Rabbi Jonathan Hausman who flew up from Boston to ride the bus with his ‘Favourite Gentile.’

At his March 21/12 Israel Truth Week Conference in London, which was held at Royal View Church (where Caledonia activist Gary McHale’s message to Christians about the evils of racism – especially anti-Semitism – and about the necessity of paying a price for their beliefs was very well received), Mark announced that the Canadian Society for Yad Vashem had offered to provide a bus to take people to Ottawa for the ceremony. Dr. Peter Marshall of the Victory International Church in Hamilton enthusiastically supported the trip and approximately half the bus’s 46 passengers were members of his 1,000-strong congregation.

Gary McHale – ‘The Caledonia Crusader’ – appeared on the Brian Lilley Show yesterday with David Menzies to talk about the racist decision by the Supreme Court of Canada to devalue the lives of victims of crime – native and non-Native –  when they and their communities are victimized by repeat native offenders.

After taping the show earlier in the day at the SUN studio in Toronto Gary and Christine McHale, along with Caledonia hero Merlyn Kinrade (all of Canadian Advocates for Charter Equality – CANACE); Mark Vandermaas (Israel Truth Week/Caledonia Victims Project); Al Gretzky & Mary Lou Ambrogio (International Free Press Society); and members of the Hamilton-based Never Again Group spent the rest of the day at the Israel Consulate on Bloor Street to support the Jewish Defence League’s call to rally against planned protests by anti-Semitic forces  in connection with the so-called, ‘Global March to Jerusalem.’

[…] The Hudak Tories have been as silent as the tomb on Caledonia. John Tory, whilst party leader, at least attempted to show concern. Being a very cautious and unimaginative pol, Tim Hudak has stayed away from the issue. In fairness to Toby Barrett, he’s stuck his neck out a bit over Caledonia. That’s one of the tragedies of Caledonia. Simple decency is now a brave thing.

Why Caledonia still matters, even six years after the Douglas Creek Estates were occupied, is not what happened that day or in the months that followed. It’s more than the beating of Sam Gualtieri, or the destruction of a hydro transformer. No it’s the response of the authorities, or more correctly the lack thereof. Crime happens, that’s an unavoidable part of life. That’s why we have a justice system. When basic laws are not enforced there is a crime greater than the mere offence in question.

Hamilton Spectator, Feb 28/12: Ten things that have changed: McHale

While to some it appears inherently wrong ever to disagree with a native person, I have to say that Ms. Bomberry’s view that nothing has changed since 2006 is not supported by the evidence. Here are10 things that have changed since 2006.

1) Contrary to the Native occupiers’ view, Six Nation Band Council has repeatedly told the court there is no claim on title to people’s property. Judges have agreed.

2) Courts have repeatedly disagreed with the OPP refusal to enforce the law and have even rebuked the OPP for targeting legal property owners instead of Native protesters.

3) The OPP has been forced to accept that property owners do have the right to have Native trespassers arrested.

Those of us who have worked to preserve the rule of law, and educate the public about the legalized myths underlying the racial policing seen in Caledonia, are pleased to see the growing media interest in the recent arrests of the Caledonia 8 and our success in finally breaching the segregated Douglas Creek Estates for the first time on Feb 18/12.  

In the eyes of talk show host Jerry Agar, who hosts on both SUN News TV and CFRB Newstalk 1010 in Toronto, innocent people with white pigment in their skin are not expendable in Caledonia, any more than any other race or culture is expendable, and the police need to stop obeying illegal orders, and honour their oaths of office to uphold the law according to the Ontario Police Services Act — even if it means telling their bosses and political masters to go to hell.

Agar went even further by effusively praising the Caledonia 8 ‘anglo white guys’ (one of our number is a very proud and strong woman named Bonnie Stephens, but I’m not complaining, just being factual) and our ‘NO JEWS ALLOWED BY ORDER OF MCGUINTY’ signs (for which Gary McHale was arrested), and called for Jewish organizations and others to get involved in helping us end the racist policies that keep Jews out of the Douglas Creek Estates occupation site, just as it keeps Blacks, Whites and other races out.

A very big worm is turning in our country: it has now become ‘officially safe’ for the media and citizens to openly talk about institutionalized racism against people with white skin.

David Strutt photos: Caledonia 8 make history on Douglas Creek Estates in Caledonia

Welcome to DCE 120218Professional photographer and graphic artist David Strutt drove from his home north of Toronto to be with members of the ‘Caledonia 8’ and our supporters on Feb 18/12 when we became the first non-natives since Feb 28/06 to walk onto the Douglas Creek Estates with United Nations and Canadian flags without asking permission from the native occupiers who terrorized Caledonia while the province’s police and Liberal government ran interference for them, and bought the site so they could remain after a judge ordered their eviction. 

Strutt is also the gifted cartoonist/artist who has created the editorial cartoons found recently here on VoiceofCanada, and was a Freedom Party candidate in the last provincial election.

McHale arrested in Caledonia because Native man assaults 77 yr old former Navy vet/UN peacekeeper & OPP officers

VoiceofCanada, Feb 06/12: David Strutt cartoon: new logo for ‘ONTARIO PARTISAN POLICE’Only in Caledonia do the police let the native thugs who attack their officers and peaceful non-native people (one of whom happens to be an elderly, cancer-ridden veteran of the Canadian Navy and a UN peacekeeping mission) go free, and arrest the peaceful leader of the non-natives for standing quietly on a county road. You just can’t make this stuff up.

Today seven of the Caledonia Eight, along with a number of Caledonia residents, supporters and spouses, did what no one has done since Feb 28/06 when the occupation there began. We walked through the gates of the Douglas Creek Estates, down the county road that runs through it, to within 100 feet or so of the only house on the site.

The visit was a surprise for the occupiers and police, who were warned shortly before we left the Lions Hall in Caledonia to drive to the site.

PHOTO BY CHRISTINE MCHALEAlthough history was made today by both the visit itself into Dalton McGuinty’s forbidden no-go zone via the county road that runs through the site; and by the first-ever arrest of a native person during the commission of a crime (an assault on Gary McHale), we clearly demonstrated once again that racial policing is very much alive.

The OPP arrested Gary McHale for the sixth time because a native man assaulted OPP officers and 77 year old Navy war veteran & UN peacekeeper Merlyn Kinrade who was wearing his blue beret and holding a UN flag.

Sadly, he also happens to be suffering from cancer. It happened right beside me. The police let the attacker go, and then arrested the non-native — Gary McHale — because he refused to leave because he wasn’t doing anything illegal. Why the arrest then? Because, according to the police, it was Gary McHale – one of the 120218 OPP ask Caledonia 8 to leave DCE even though things are quiet after arrest of native woman. One observer who has never attended one of our protests sent me this comment:

“I’m still trying to get it through my head that Gary was arrested in order to stop the natives from continuing to break the law. This is just ludicrous.” Continue reading
