UPDATE, Feb 05/13: Gary McHale was awarded his Queen’s Diamond Jubilee Medal at a ceremony in Toronto on Feb 01/13 by Federal/Ontario Director of the Canadian Taxpayers Federation. Afterwards he recorded an interview with Michael Coren which aired that night.

After nearly seven years of fighting against incredible odds to confront the Ontario government’s illegal ‘peacekeeping‘ mission in Caledonia alongside Gary McHale, I am so very pleased that the Canadian Taxpayers Federation will award Gary the Queen’s Diamond Jubilee Medal in honour of his dedication to that struggle:

“The more we thought about it, the more we saw that people who should be recognized wouldn’t be recognized,” he said. “These are the kind of people we wanted to recognize. They’ve challenged the status quo. Gary McHale fits the bill. He has fought, in our view, for the equal application of the law and the execution of court orders. He’s taken some risks and some beatings over this, both literally and figuratively.”

THE END OF THE BEGINNING! After 4 arrests & a 31 month campaign Canadians force OPP to respect their right to raise a Canadian flag in Caledonia.

In early 2007 after we were arrested together on Dec 16/06 while trying to raise a Canadian flag opposite the occupation site; during a time when former OPP Commissioner and the OPPA and the media were printing the most vile accusations against him and his followers; and knowing that York Regional Police had been in his home to respond to threats against Gary and his wife Christine from occupation militants; and knowing just how politically-incorrect our mission to end race-based policing was, I said to Gary:

“If, when this struggle is over,  we’re still alive and not in jail, everything else will be a bonus, but no one is going to be pinning any medals on us.”

I’m so glad I was wrong — about the medal. Six Nations militants did try to kill Gary on Dec 02/07 when occupation ringleader Clyde Powless jumped on his back and other cowards joined in, kicking him and screaming obscenitie while he lay on the ground. Fortunately, a quick thinking Doug Fleming tackled Powless and some badly outnumbered OPP officers hustled Gary out of the area. Despite being viciously assaulted Gary never once raised an angry voice or fist in retaliation.

For more six years I have had the honour (and, yes, the frustration sometimes), of working beside a stubborn, determined man who refused – and refuses – to give up until this province and its police force end racial policing and, once again, respect the rule of law.

UPDATED Oct 26/12 — A great Canadian patriot, naval veteran, peacekeeper, father, husband, friend of Israel and a tireless force for justice in Caledonia has been called home.

I am saddened to report that Merlyn Kinrade, Caledonia resident and co-founder of CANACE (Canadian Advocates for Charter Equality), died after a long battle with cancer at 2pm yesterday – Saturday, October 06, 2012. He was born March 16, 1935, and passed in his 77th year.

About Merlyn Kinrade

Merlyn Kinrade lived more than 60 years of his life in Caledonia. He is a former member of the Royal Canadian Navy who served on one of the most famous ships in Canadian naval history, HMCS Haida. His service included a tour of duty in Port Said, Egypt on a United Nations peacekeeping mission during the 1956 Suez crisis.

Dear Mr. Barrett,

Today I had the distasteful experience of reading your assistant’s insulting email about our invitation to give Tim Hudak and the party the opportunity to march in Caledonia with us against racial policing so you all can share in the positive media coverage we are generating on this issue. After investing more than five years of my life working alongside other citizen volunteers to honour the oath I swore as a soldier to defend Canada so long ago, I scarcely know what to say to a ‘Conservative’ MPP whose long time assistant denigrates our efforts to hold McGuinty accountable as “Just more of Gary’s same ol’ shit – at least it keeps him busy!!”

I appreciate that Rob called Gary to apologize, but why did he bother? Clearly his attitude reflects the party’s. The only thing I suspect he’s really sorry for is forwarding a copy of the email to Gary McHale in error.

Some Canadians have paid a heavy price to give you opportunity after opportunity to take a stand against McGuinty’s racial policing, but your leader won’t even come to Caledonia, let alone work with us to develop policy and strategy to ensure there will be no future victims. We presented our ‘Caledonia Act’ recommendations to you, based on our years of full time, volunteer work in Caledonia so you could learn from our experience fighting lawlessness and racial policing in and out of the courts. We received no response, no follow-up request to help the party move them forward.

The Ipperwash Papers Project As the leader of the Ipperwash Papers project I am utterly dismayed that during the 5 years since we first released the 400 pages of documents on March 14/07 at Queen’s Park (just months before Sam Gualtieri was nearly murdered in the Stirling subdivision) the Ontario PC Party still refuses – to this day! – to hold McGuinty accountable for his use of the racially-skewed Ipperwash Inquiry recommendations to ‘justify’ why the people of Caledonia have been ignored and allowed to suffer via an illegal ‘peacekeeping’ mission on Canadian soil.

McHale arrested in Caledonia because Native man assaults 77 yr old former Navy vet/UN peacekeeper & OPP officers

VoiceofCanada, Feb 06/12: David Strutt cartoon: new logo for ‘ONTARIO PARTISAN POLICE’Only in Caledonia do the police let the native thugs who attack their officers and peaceful non-native people (one of whom happens to be an elderly, cancer-ridden veteran of the Canadian Navy and a UN peacekeeping mission) go free, and arrest the peaceful leader of the non-natives for standing quietly on a county road. You just can’t make this stuff up.

Today seven of the Caledonia Eight, along with a number of Caledonia residents, supporters and spouses, did what no one has done since Feb 28/06 when the occupation there began. We walked through the gates of the Douglas Creek Estates, down the county road that runs through it, to within 100 feet or so of the only house on the site.

The visit was a surprise for the occupiers and police, who were warned shortly before we left the Lions Hall in Caledonia to drive to the site.

PHOTO BY CHRISTINE MCHALEAlthough history was made today by both the visit itself into Dalton McGuinty’s forbidden no-go zone via the county road that runs through the site; and by the first-ever arrest of a native person during the commission of a crime (an assault on Gary McHale), we clearly demonstrated once again that racial policing is very much alive.

The OPP arrested Gary McHale for the sixth time because a native man assaulted OPP officers and 77 year old Navy war veteran & UN peacekeeper Merlyn Kinrade who was wearing his blue beret and holding a UN flag.

Sadly, he also happens to be suffering from cancer. It happened right beside me. The police let the attacker go, and then arrested the non-native — Gary McHale — because he refused to leave because he wasn’t doing anything illegal. Why the arrest then? Because, according to the police, it was Gary McHale – one of the 120218 OPP ask Caledonia 8 to leave DCE even though things are quiet after arrest of native woman. One observer who has never attended one of our protests sent me this comment:

“I’m still trying to get it through my head that Gary was arrested in order to stop the natives from continuing to break the law. This is just ludicrous.” Continue reading

MPP Toby Barrett praises McHale, CANACE for Caledonia ideas, media attention

“Barrett credits Gary Mchale and CANACE for keeping the issue alive in the media and in the limelight, suggesting a lot of McHale’s ideas have been ‘pretty good’.” They include having more oversight from the Ontario Ombudsman with respect to the OPP and more protection for whistleblowers in the Police service.

Gary McHale of CANACE (Canadian Advocates for Charter Equality) explained that the conference was called in response to the arrests of the Caledonia Eight on Dec 03/11 while walking on a county road through the occupied Douglas Creek Estates, and the subsequent arrest of Gary McHale on Jan 27/12 after he and Caledonia resident Randy Fleming erected a sign at the occupation site which said, ‘NO JEWS ALLOWED BY ORDER OF MCGUINTY’ to draw attention to the reality that the exclusion of non-Natives from the site applies to all races. 

He also condemned the racially-biased Ipperwash Inquiry, nearly five years after we held our first press conference in the same room to release our Ipperwash Papers project [ALSO]:

 McGuinty created the Ipperwash Inquiry, not to look into ending the violence but to ensure no Aboriginal is ever harmed regardless of violent crimes Aboriginals commit during so-called land claim occupations. In McGuinty’s Ipperwash Inquiry not one non-Aboriginal resident of Ipperwash was permitted to testify – in McGuinty’s Ontario the views of non-Aboriginals have no bearing on government policies. This is why the result of the Ipperwash Inquiry has been used to twist OPP policies to ensure laws are not enforced, Charter Rights of non-Aboriginals are not upheld, that public safety is defined only by ensuring no Aboriginal is harmed, and law enforcement has been replaced by an illegal peacekeeping mission.

'The Caledonia Act' news conference, Queen's Park, Feb 10/12: Stuart Laughton, Never Again GroupStuart Laughton of the Never Again Group, in an inspiring, eloquent and reasoned speech, endorsed the ‘NO JEWS ALLOWED BY ORDER OF MCGUINTY’ sign erected at the occupation site and called on the McGuinty government to end racial policing by arguing for equality and protection of the ultimate minority group – the individual. 

Miroslav Marinov, a Toronto blogger who has made several trips to Caledonia to see racial policing in action with his own eyes, described Stuart’s presentation thus in an email to me: “Stuart Laughton’s short speech is one of the best analyses of legal and social consequences of Ontario government’s policies in Caledonia.”

‘No Blacks, Whites or Jews Allowed by Order of McGuinty’ – by Gary McHale

“…the law in Haldimand County operates as the law in America’s Deep South once worked, where there was one law for the white man, who could break it with impunity, and another for the black man. In Haldimand County, since the occupation began, there has been one law for natives and another for non-natives.“

What does the term ‘Non-Native’ really mean? ‘Rights for Whites?’ Or ‘Rights for All?’

For five years we have been engaged in a struggle to end OPP race-based policing directed against “non-native” people.  During that time many journalists have used the ‘non-native’ term, including Christie Blatchford, author of the Helpless: Caledonia’s Nightmare of Fear And Anarchy, And How The Law Failed All of Us, in which she laid bare much of the damning evidence proving that OPP officers were given, and followed, orders to conduct racial policing. 

On May 04/11, barely six months after release of Helpless Blatchford wrote a story after witnessing the shocking testimony of an OPP officer attempting to justify why the force was again trying to exclude Gary McHale from certain areas of Caledonia after arresting him on a trumped-up assault charge (later dropped by the Crown prior to trial) in which she wrote the words above comparing the law in Caledonia/Haldimand County to the blatantly biased workings of the racist Deep South.

VIDEO: The Caledonia Eight Arrested

UPDATED Dec 09/11 — CANACE’s Director of Multimedia Production Jeff Parkinson has released a short movie that tells the story of the arrests of the Caledonia 8 on the Douglas Creek Estates on Dec 03/11.

Jeff himself was arrested, but handed the camera over to Christine McHale when it was his turn line to wear handcuffs so she could continue documenting the scene. Jeff is shown kneeling in the photo below.

TRIVIA: You’ll see a rather humorous scene where I’m bent over trying to get into the paddy wagon but the door is too small for my shoulders and it was almost impossible to twist sideways with my hands cuffed. As you watch me try to get through the door you’ll hear me say, “If the van doesn’t fit you must acquit” (with apologies to Johnny Cochran).

MORE TRIVIA: While we were inside the van Jeff asked if anyone knew any civil rights songs so I led the seven of us (Gary McHale was taken by other means of transport) in ‘We Shall Overcome,’ so that’s my voice you first hear singing from inside the van. I didn’t see Bonnie so I assumed she had been taken away with Gary, but she was, in fact, with us in another part of the paddywagon:

There was a separate, small cell built into the van directly behind the front passenger side seat.  I was sitting in there, but I could see out because there were rows of small holes in the side, sliding door that closed off the approximately 4′ x 4′ “cell” where I was.  I could hear you guys behind me in the back.  I heard you talking to each other, but I couldn’t make out all the words.  I heard you singing and I joined in, and I heard Randy Fleming most clearly, so that might help you figure out where I was in relation to yourself.  I think that you were on the driver side, so I was across from you. I might add that I was quite proud of my calmness because I am very claustrophobic.”

CAUGHT ON TAPE: Native occupier threatens non-native woman in Caledonia’s ‘no-go zone’

CANACE’s videographer Jeff Parkinson caught a threat made against Bonnie Stephens by a native occupier while she was waiting for police to arrest her during our Saturday protest in Caledonia where eight of us were arrested for ‘trespassing’ on a Haldimand County road. The man can be heard clearly saying, “Come again and the cops won’t be here to protect you.”

VoC Comment

Even after 5 years of work in Caledonia, even after I and my associates were smeared and assaulted (several put in the hospital) and our property stolen and destroyed by Six Nations militants who ripped apart the community I must confess to still being surprized at just how much violence permeates the attitudes of some of the occupiers. Imagine – threatening a non-native woman for simply daring to stand on a county road! A road that has been declared off-limits to non-natives (and police!) by violent racists whose delusions are backed up by our province’s police force and the Ontario government.  

I am reminded of Christie Blatchford’s observation:

CANACE, founded by Gary McHale, and the Caledonia Victims Project, founded by Mark Vandermaas, are holding a Truth and Reconciliation Rally in Caledonia as part of their on-going efforts to bring about lasting peace based on truth, justice, mutual respect and restoration of the Rule of Law. 

A Father’s Day Barbecue will precede the rally from 12 noon to 2 pm Sunday June 19th where we will be serving free hotdogs and drinks to the public at the farm of Mr. Ernie Palmer [LINK, MAP]. All are welcome to drop in to chat and listen to the music of multi-instrumentalist Stuart Laughton who was an original member of Canadian Brass [LINK] and founder of the roots-rock band Porkbelly Futures [LINK]. He is also Founder & Artistic Director of The Forest Festival [LINK] in Haliburton, Ontario. Stuart will be singing and playing guitar on a selection of favourite songs by Willie P. Bennett, James Taylor, Jim Cuddy, Ron Sexsmith and others. 

At 2 p.m. we will go to Douglas Creek Estates to place our Truth and Reconciliation Monument on the road allowance at the entrance to DCE. At both our Feb. 27 and Mar. 27 rallies the OPP refused to uphold the law as non-natives were swarmed, harassed and assaulted. During the Feb. event the OPP refused to remove trespassers on the private property we were using, but later arrested Gary McHale for attempting to remove their leader who had led a large group of pro-occupation activists to swarm him, and refused instructions to leave. That charge has now been withdrawn by the Crown [LINK]. On March 27th the OPP allowed the occupiers to steal, destroy, then burn our original monument along with our Canadian flag [LINK].

CANACE media release: McHale to seek charges of Assault, Mischief vs. CUPE 3903 leader of Caledonia confrontation

Following up on the Crown’s decision to drop the Assault charge brought against him by CUPE 3903 leader Tom Keefer in connection with a Feb 27/11 Caledonia protest Gary McHale has issued a news release with additional information.

In addition to outlining details regarding the circumstances of the case, McHale states that he will be using the private prosecution provisions of the Criminal Code to ask the Court to issue process for charges of Assault, Mischief and Counselling Mischief against Mr. Keefer, and will also be seeking to have charges of Mischief certified against those who joined Keefer “to interfere with the use of private property.”

Basis of charges vs. Keefer et al

Section 41 of the Criminal Code of Canada provides that property owners/agents may remove trespassers using reasonable force, and trespassers who resist removal are deemed to have committed an assault against the owner:

Not only does McHale have a wealth of experience in the criminal courts in the field of private prosecutions (see below), convincing a judge that there is evidence for the charges against Keefer and his followers should prove easy since the statements they made to the OPP in hopes of seeing McHale convicted of Assault can now be used against them.

Liberal Bob Speller first federal candidate to offer Caledonia policy statement

Liberal Party candidate Bob Speller (Haldimand-Norfolk) has become the first federal candidate in the 2011 election to issue a policy statement regarding the breakdown of the rule of law in Caledonia.  

Speller’s statement – which referenced Christie Blatchford’s book Helpless on several occasions – was read at our Conservatives Against Racism townhall presentation held last night at the Delhi Belgian Club by the president of the Haldimand-Norfolk Liberal Electoral District Association, Herb Ibbotson. It was much stronger than any us could have hoped for, and it referenced every aspect of the crisis: land claims; illegal tobacco; the rule of law; property rights; and helping victims (the full text of Mr. Speller’s statement is reprinted below followed by a VoC comment):

“There is nothing more important than the rule of law. We have troops in Afghanistan and our air force flying in the skies of Libya to ensure those countries have the rule of law. Most readers know that I and Merlyn Kinrade are ex-military and former UN peacekeepers, and so we were pleased to discover, before the event began, that Herb Ibbotson had served as an officer in the Canadian Artillery Reserve for 21 years.  Later, he explained to the crowd that seven members of his family were killed during World War I defending his ancestral country of Belgium, and asked us all if we knew why Canada’s flag was red and white. I did not know that red and white were colours bestowed on Canada by King George in recognition of Canada’s terrible sacrifice in the Great War. Clearly, he was struck by what he had heard during the presentation, and the importance of defending the rule of law.

The format of this event will be that we will do a 75 minute presentation, then allow each candidate 6 minutes to say anything they want to the public (of course, we encourage each candidate to speak to the issues raised in our presentation). We will then have a Q&A time. Candidates are encourage to bring their material to hand out. There will be a time for people to meet with the Candidates after the Q&A – event ends at 10 p.m.

VIDEO: Native occupiers ‘respectfully’ destroy and burn Reconciliation/Apology monument & Cdn flag in Caledonia

March 27/11 - Native occupiers of Douglas Creek Estates in Caledonia burn our Truth & Reconciliation/Apology monument and our Canadian flag within minutes of attacking us - all while OPP officers watchedIn my last article I posted photos showing how OPP officers stood by and watched on March 27/11 as we were swarmed by native thugs from the occupied Douglas Creek Estates in Caledonia who stole our Reconciliation/Apology monument; kicked it into the road; smashed holes in the sides; inserted Six Nations flags; then carried it off to be burnt along with our Canadian – all while OPP officers watched.

Jeff Parkinson caught the action on video which has now been posted. Watch as a woman in a rage attacks the monument and then kicks and drags the base into the road where a plainclothes OPP officer from the Provincial Liaison Team then pulls it off to the side of the road before it gets carried off to be burnt.
