The Hamilton Spectator’s Dan Nolan has quoted Councillor Lorne Boyko, chair of the Haldimand Police Services Board – responsible for overseeing policing in Caledonia – as making a number of remarks that long-suffering victims of native extremists there may find extremely distasteful. 

The Spectator published a story today quoting the reactions of various players in the Caledonia crisis to the appointment of Chris Lewis to the position of OPP Commissioner, including Gary McHale, Haldimand Mayor Marie Trainer, and Boyko.

UPDATED 1026 July 09/10 — Ontario Premier Dalton McGuinty has appointed Deputy Commissioner Chris Lewis as the new head of the Ontario Provincial Police. Lewis is one of two senior Fantino underlings who faced Obstructing Justice charges for following his boss’s explicit orders to target Gary McHale for a criminal charge at the outset of an investigation, and not to “get bogged down with legal nuances” in order to do it.

The Ottawa Citizen’s story was the first to acknowledge the charge, followed by the Hamilton Spectator one day later:

Fantino faced criminal charges earlier this year, which were later dropped by the Crown, over allegations of attempting to influence a municipal official during the native occupation in Caledonia. Lewis, too, faced a charge of attempting to obstruct justice in the same matter. The charge was also dropped, he said.

The issue led to activist Gary McHale founding a movement –Canadian Advocates for Charter Equality — and, in some cases, saw him charging OPP officers for alleging overstepping their authority in the affair. This included Lewis, who was accused of obstruction of justice by McHale in regards to a 2007 rally. The charge was dropped in May.

“Haldimand County Mayor Marie Trainer is calling on new OPP Commissioner Chris Lewis to end what she terms was the practice of two-tier justice in Caledonia under outgoing Commissioner Julian Fantino.”

OPPA internal documents show Chris Lewis made DCE occupation a ‘homefree zone’ for native criminals

Unfortunately, Mayor Trainer’s call on Chris Lewis to end two-tier justice/racial policing will likely fall on deaf ears since he was one of its key architects and enforcers. 

Christie Blatchford, who is writing a book about Caledonia that should be ready later this year, reveals that internal documents from the Ontario Provincial Police Association (the very organization that falsely accused Gary McHale and Mark Vandermaas of inciting violence and hatred in a 2007 press release, and is currently being sued for defamation by the two) show that Chris Lewis made it clear native criminals scampering back onto the Douglas Creek Estates occupation site bought by the province were absolutely untouchable by the OPP – unless, perhaps, they kidnapped somebody’s child (emphasis by VoC):

The Globe and Mail has obtained OPPA minutes of the spring, 2008, meeting, one of two that the force’s senior command have every year with the police union and where they answer questions.

The minutes show that Detective-Sergeant Roger Geysons, president of the branch encompassing Caledonia, prefaced a question by noting that there had been several recent occurrences “involving First Nations persons observed committing a criminal act and subsequently fleeing” onto DCE.

He demanded to know what written orders there were, and concluded, “Are OPP members allowed on DCE?”

Mr. Lewis, then deputy commissioner, with Commissioner Fantino at his side, replied that it was “news to me that this was still an issue” and said, “Short of somebody having a kid kidnapped and running onto the DCE, we’re not going to go onto that property. It’s just a recipe for disaster and it will set things back there.”

Gary McHale’s associate and fellow CANACE co-founder Jeff Parkinson has seen racial policing up close. He made legal history with McHale’s help after fighting a two year battle that culminated when the Crown withdrew charges of Mischief ordered by a Superior Court judge against two OPP officers he filmed assisting native protesters to build a barricade to keep the lawful owner out of his Hagersville property: 

[Lewis has] been working closely with Julian Fantino to make crucial decisions that have oppressed the rights of non Natives in Caledonia.

He was the architect of the ART team (now known as the provincial liaison team) who were responsible for pandering to the whims of Natives while turning a blind eye to criminal behaviour. It’s hard to imagine such a stupid idea as a “response” team within a police force that’s dedicated to one race of people, but that’s what happened under the leadership of the soon to be commissioner. […]

Lewis shows absolutely no remorse for the unreasonable manner in which he helped persecute an innocent man. When asked by the Globe & Mail if he had any regrets in the way that McHale was pursued, he said “none, absolutely none”.

I first began begging the Canadian Civil Liberties Association for help on behalf of Caledonia’s victims in early 2007 beginning with a phone call and email after we were arrested for trying to raise a Canadian flag in December 2006. Sadly, they simply refused to respond to my requests, even after I drove from London to Toronto to personally deliver a draft copy of The Human Costs of Illegal Occupations report which detailed the horrors of racial policing and the violence aided and abetted by OPP officers who refused to act against native rioters.

Gary McHale to appear on Michael Coren Show

UPDATED May 31/10 — Gary McHale will appear on the Michael Coren show on Tuesday, June 01/10.

Coren had originally scheduled McHale for just a half-hour session, but after reviewing some of the documentation provided, he decided to devote the entire show to McHale and Caledonia.

My understanding is that one of the key topics to be discussed is the targeting of McHale for criminal charges by the OPP despite the lack of evidence. This will, of course, lead to a very interesting discussion about the racial policing practices used against Haldimand County residents.

The show will be aired Tuesday night at 6pm on CTS TV and again on Wednesday at 12:30 pm.

OPP set up McHale & supporters for violence, false criminal charges – again

Native protesters & supporters interfere with CANACE anti-racism rally for 2nd straight week trying to incite responses from residents & organizers. Crashers placed their own banner behind CANACE founder Merlyn Kinrade as he announced the cancellation of the event due to lack of police presence.

UPDATED 1115 March 30/10 — For the second week in a row native protesters and supporters forced the cancellation of CANACE’s Anti-Racism Rally in Caledonia after they confronted organizers and residents, surrounded them and heckled Gary McHale as he explained why he and Merlyn felt it necessary to again call off the event – all without a single OPP officer present to separate and control the two sides.

You can see some of the native protesters w/CUPE members coming to confront the CANACE protesters in the photo below with absolutely no police presence. Above, they made sure to hold their banners behind Merlyn as he spoke while others mingled with the residents who came out to hear speeches about racial policing and how it has caused terrible trauma to residents. 

UPDATE: Gary McHale informed me after publication that he saw a handful of officers standing “150 feet away.”

The speech native protesters and CUPE didn’t want you to hear

Sachem-Dring Randy Fleming May24-09Although police have lined up numerous time to stop non-natives from walking down a street near the occupation site, and four people (Randy Fleming, photo R), including both McHale and me, have been arrested to prevent a ‘breach of the peace’ because we dared try to raise a Canadian flag, there was not a single officer present to keep native protesters and their supporters apart to prevent them from disrupting the CANACE event. The only police presence I observed was a single officer videotaping the event. That was it. Clearly the OPP were trying to do the very same thing as was done on Dec 01/07 – set up a situation where violence could break out and then blame it all on McHale:

Not only do native protesters have a long history of violence in Caledonia, including the vicious assault on Gary McHale on Dec 01/07 which I discussed in ‘Why Merlyn’s Anti-Racism rally is rescheduled for this coming Sunday, some native protesters have fabricated false allegations against non-natives in order to incite violence, and then have others falsify ‘corroborating’ witness accounts. The worst of the violence on Dec 1st was actually incited by a false allegation of assault by Camille Powless against Gary McHale.

CUPE 3903 leader Tom Keefer first became known to CANACE due to his June 23/09 attempt to orchestrate a vicious smear campaign, with help from numerous other groups, to falsely link CANACE founders and Doug Fleming to neo-nazis and white supremacists. We subsequently learned, from his own words videotaped at a Cayuga protest, that he and CUPE and 0ther groups have been supporting the DCE occupation ever since the April 20/06 failed OPP raid.

Some “historical context” about imaginary Caledonia land claims and treaty rights

UPDATED — Does Six Nations actually own the Haldimand Tract and the Douglas Creek Estates as native protesters allege? Do native people have the right to break the law during a land claim dispute?

This post was inspired by a comment I received from a reader who objected to my article about the upcoming Anti-Racism Rally organized by Merlyn Kinrade & CANACE scheduled for this coming Sunday March 21/10 at 2pm at the Caledonia Lions Hall.

1. Six Nations has no treaties with Canada that allow native thugs to attack and intimidate Canadian citizens as an alternative to using the courts to settle their grievances.

2. The issue of ownership of the Haldimand Tract was decided in 1974 by the Court of Appeal in the case of Isaac v. Davey, which decision was cited by two separate Superior Court judges in ordering injunctions to end Haldimand Tract occupations since 2006 — one in Cayuga and one in Hagersville:

  • 1536412 Ontario Ltd. v. HCCC, HDI, Ruby & Floyd Montour, Hazel Hill 
    (Cayuga occupation, May-June 2008) [LINK]
  • John Voortman & Associates v. HMF

a. Both judges said the two recognized bodies of Six Nations have made NO claim for ownership or possession of the Haldimand Tract, and even if they did, the claim would fail. The ONLY claim that Six Nations might have is for economic damages. Continue reading

Minister knew about OPP obstruction allegations in 2008

UPDATED 1308 March 19/10 — Nearly two years before yesterday’s issuance of Obstructing Justice charges against OPP Deputy Commissioner Chris Lewis and Superintendent Ron Gentle, the Minister of Community Safety and Correctional Services Rick Bartolucci was informed  that serious allegations of possible criminal conduct were being made against the OPP in connection with their investigation of the Dec 01/07 Caledonia protest and the resulting charge against Gary McHale.

On May 30/08, on behalf of Gary McHale, Jeff Parkinson and myself, I sent a 71 page complaint under the Police Services Act to the Minister which summarized evidence alleging that Julian Fantino may have committed three criminal offences  — Obstructing Justice, Influencing Municipal Official and Breach of Trust — and asked that the RCMP be called in to investigate.

Although I/we did not, at that time, have the damning OPP emails that have now resulted in charges against Lewis and Gentle the minister was supplied with an extraordinary amount of detailed information that should have had him ringing alarm bells at RCMP HQ. Clearly, he should have been concerned: a Superior Court judge believed there was evidence to charge Fantino with Influencing Municipal Officials and now, a justice of the peace has issued process for Obstructing Justice charges against Lewis and Gentle for their involvement in the Dec 01/07 investigation.

Not only did Bartolucci refuse to call in the RCMP to investigate he didn’t bother to ask for supporting documents before dismissing the complaint out of hand. Despite a follow-up letter from me, he did not even address part 3 of the complaint which alleged Fantino may have committed a Breach of Trust by lying to the public about McHale and me.

Senior OPP officers charged w/Obstructing Justice in McHale case

UPDATE April 14/10: Gary McHale advises that, as expected, the Crown today dropped the charges against Deputy Commissioner Lewis and Superintendent Gentle after fast-tracking the hearing from April 28th to today. The Crown dropped the charge without even consulting the victim of the alleged obstruction of justice – McHale who expects to apply for a judicial review in Superior Court.

(UPDATED July 07/10) Gary McHale has confirmed that in a hearing before a Cayuga Justice of the Peace today (March 16/10), he presented sufficient evidence to convince the Justice to order that charges of Obstructing Justice be issued against OPP Deputy Commissioner Chris Lewis and Superintendent Ron Gentle for their role in having him arrested after a Dec 01/07 protest where he and other non-native protesters were attacked by Six Nations people supporting an illegal smokeshack.

139(2): Every one who wilfully attempts in any manner other than a manner described in subsection (1) to obstruct, pervert or defeat the course of justice is guilty of an indictable offence and liable to imprisonment for a term not exceeding ten years.

OPP spokesman Dave Ross said he could not comment because the force had not received any information about or confirmation of the charges yesterday.

McHale said Ross issued a summons for the two officers to appear in Cayuga court April 28.

Merlyn Kinrade calls for Rallies in Caledonia

Regional News this Week – Feb. 24, 2010

This past Friday Mr. Chris Bentley, the new Aboriginal Affairs Minister who is also the Attorney General of Ontario, met with Haldimand Council at a Tim Hortons in Brantford. After the meeting Mayor Trainer told people that she directly asked Mr. Bentley if the province had already decided to give DCE to Six Nations. She reported his reply was yes.

Merlyn Kinrade contacted the Mayor the same day to verify that this did occur and the Mayor confirmed to Mr. Kinrade that it was true. Mr. Kinrade saw this as the final straw of rewarding people for criminal behaviour and as such he calls upon people to rally in Caledonia on March 21 to help bring an end to the racist policies of the Ontario Government.

For four years the people of Haldimand county have been forced to endure what almost every media outlet in Ontario has called Two Tier Justice or Race Based Policing. There appears to be no limit to the level of appeasement that is done to ensure that certain radical elements from Six Nations stop committing criminal acts.

In June of 2006 David Peterson arranged a deal to pay the criminals who dug up the road and barricaded the highway for 5 weeks to be rewarded with the Burtch Tract in return for bringing down the barricades.

Sun reporter equates opposition of Caledonia ‘apartheid’ to anti-Israeli activities

If one wants to know why the public is turning their back on traditional media, one needs to look no further than SunMedia reporter Jonathan Jenkins’ article about the Legislature’s unanimous condemnation of the use of the word ‘apartheid’ in connection with anti-Israel campus activities.

Here are the final three paras from the London Free Press version of the article which can also be found on the Toronto Sun website (bolded passages by VoC):

But [MPP Peter] Shurman’s objection to the use of the word apartheid did not extend to condemning those who would use it in the context of the aboriginal land claim in Caledonia, which has led to a bitter standoff and the occupation of the Douglas Creek Estates.

Activist Gary McHale has used the term in his efforts to evict the native protesters from the land but Shurman said he saw nothing similar in the usage.

“For a variety of reasons, it’s not really comparable,” Shurman said.

I have read various laments from LFP contributors and editors regarding the move by readers away from so-called ‘mainstream media.’ The article, ‘House condemns campus use of ‘apartheid’ is a perfect example of why this move may be occurring. Reporter Jonathan Jenkins asserts that, “Activist Gary McHale has used the term [apartheid] in his efforts to evict the native protesters” from Caledonia’s Douglas Creek Estates (DCE). Mr. McHale subsequently contacted Mr. Jenkins who told him he read this in an article on a website belonging to Mr. McHale’s organization Canadian Advocates for Charter Equality (CANACE).

Superior Court Justice Crane certifies Caledonia Class Action lawsuit

The Caledonia Class Action lawsuit has passed the last major hurdle that ensures it will go to trial. Justice Crane of the Superior Court today certified the action and released the reasons for his ruling.

According to the ruling, notice of the certification must be posted – at the Defendant’s expense – in the Globe and Mail; Hamilton Spectator; Regional News; Grand River Sachem; Simcoe Reformer; and posted on the www.caledoniaclassaction.com website; on the Caledonia Regional Chamber of Commerce website at www.caledonia-ontario.com; Haldimand County website at www.haldimandcounty.ca; on the website of the Ontario Secretariat of Aboriginal Affairs at www.aboriginalaffairs.osaa.gov.on.ca; and – best of all – on the website of the Ontario Provincial Police at www.opp.ca.

The enemy is now encircled

Certification means that the Ontario government and the OPP’s racial policing policies have now been caught in an encircling attack by civil litigation, criminal prosecutions, critical scrutiny by both media and members of the PC Party in the Legislature.

The Toronto Star is reporting today that when Ontario Premier McGuinty was asked if Julian Fantino will step down now that he is charged with influencing municipal officials he said he will not. The Premier also downplayed the charge against Fantino by misleading the public into believing that the charge is somehow legally insignificant or lesser of a charge because it was filed by McHale through the private prosecution provisions of the Criminal Code:

McGuinty downplayed the allegations, saying he didn’t think Fantino should take a leave from his duties while the case progresses. “My understanding is that it’s a private information being put forward by a private citizen, it’s going to work its way through the courts and I’ll try to all that to take its normal course,” McGuinty said.

Premier of Ontario shows contempt for Superior Court decision

The premier is deliberately misleading the public about the nature of the charge against Fantino and, in the process, is showing extraordinary contempt for the decision of a Superior Court judge who reviewed the evidence; rejected the government’s arguments and issued process for a charge that – according to an Osgoode Hall criminal law professor – “is no different than if filed by police,” according to a story published just today in the National Post which also points out the conflict of interest on the part of the government:
